OUR PRIVACY POLICY

PRIVACY POLICY

Effective Date: January 29, 2026

Last Updated: October 15, 2026

AM Photography LLC (“Company,” “I,” “we,” or “us”) is committed to respecting and protecting the privacy of your personal information. This Privacy Policy describes what information is collected through https://amphotography108.com(the “Website”) and how it is used. The term “you” refers to any user, visitor, or viewer of the Website.

This Policy is a notice, not a contract, and it does not replace the consent you give (or decline to give) through our cookie banner. Where optional analytics, advertising, or marketing cookies are concerned, we process that data only after you consent via our cookie banner, and you may change or withdraw that consent at any time.

1. Information We Collect and How It Is Used

A. Information You Voluntarily Provide

We collect personal information that you voluntarily submit when interacting with our Website, including when placing an order for fine art prints, subscribing to our newsletter, submitting an inquiry via our contact form, or leaving a comment. This information may include:

  • Identity & Contact Details: First and last name, email address, phone number, and billing/shipping address.
  • Transaction Details: Order history and fulfillment details. All credit card and payment processing is handled securely by PCI-compliant third-party payment processors (including through our print fulfillment platform); we do not store full credit card numbers on our servers.

We use this information to fulfill print orders, communicate regarding purchases, deliver customer support, provide newsletter updates with your consent, and administer our business operations.

B. Information Collected Automatically

When you navigate the Website, we and our service providers automatically collect technical browsing data through standard server logs, our hosting network, and analytics tools. This includes your browser type, operating system, device characteristics, referring URLs, pages visited, time spent on pages, and general geographic region (country, state, and city derived from your IP address at the time of collection). This data is used in aggregate to optimize portfolio performance, diagnose technical issues, and improve site navigation.

2. Our Service Providers

We share personal information only with service providers that help us operate the Website, and only as needed to perform their functions. Our principal service providers include:

  • Website content delivery and security (Cloudflare): Cloudflare delivers and protects our Website and collects technical data such as IP addresses and request logs for performance and security purposes. See Cloudflare’s Privacy Policy.
  • Consent management (CookieYes): CookieYes operates our cookie banner and stores your consent preferences. See CookieYes’s Privacy Policy.
  • Web analytics (Google): Google Analytics 4, described in Section 4.
  • Print galleries and storefront (Pic-Time): Our online galleries are powered by Pic-Time. Where you place a print order through our gallery platform, order, payment, shipping, and contact information is processed by Pic-Time and its payment and print partners. See Pic-Time.
  • Surveys and client tools (HoneyBook): An embedded HoneyBook widget appears on our survey page and processes any information you submit through it. See HoneyBook.
  • Forms and newsletter tools (WordPress/Fluent Forms): Information submitted through our contact and newsletter forms is received through our Website’s form tools and managed through our email marketing tools.

We expect our service providers to protect personal information, to process it only as needed to provide their services, and not to use it for their own independent marketing purposes.

3. Legal Bases for Processing (GDPR / International Visitors)

Where the EU GDPR or UK GDPR applies to our processing, we rely on the following legal bases pursuant to Article 6:

  • Performance of a Contract: Processing required to fulfill and deliver fine art print purchases or take requested pre-contractual steps.
  • Consent: Processing based on your clear, affirmative consent (e.g., subscribing to our marketing newsletter or enabling non-essential analytics/advertising cookies via our consent banner). You may withdraw consent at any time.
  • Legitimate Interests: Processing necessary for our legitimate business interests, including site security, fraud prevention, and optimizing visual storefront performance, provided your fundamental rights do not override those interests.
  • Legal Obligation: Processing required to comply with statutory accounting, taxation, and financial reporting mandates.

If you reside in Switzerland, we handle your personal information consistently with the Swiss Federal Act on Data Protection (FADP), and you may contact us as provided in Section 14 regarding your data.

4. Google Analytics & Advertising Features

We use Google Analytics 4 (GA4) on https://amphotography108.com to analyze audience engagement, optimize fine art print storefront performance, and improve website navigation. Google Analytics is a web analytics service operated by Google LLC (“Google”). See Google’s Privacy & Terms.amphotography108

A. Categories of Data Collected

Google Analytics collects technical interaction data, including:

  • Technical Identifiers: Browser engine, operating system, device model, and display resolution. Google Analytics does not log or store your IP address; your IP address is used momentarily to derive approximate geographic data (country, region, and city) and is then immediately discarded.
  • Browsing Behavior: Session duration, pages viewed, scroll depth, navigation flows, referring URLs, and outbound link clicks.
  • Storefront Interactions: Gallery and print collection page views, cart interactions, and transaction metrics (such as order totals and purchase quantities, excluding payment card credentials), where enabled.
  • Approximate Geographic Region: Country, state/region, and city-level data derived from your IP address at the time of collection.

B. Demographics, Interest Reporting & “Sharing” Disclosures

Where we have enabled them, we use Google Analytics Advertising Features, including Google Signals and Demographics and Interest Reports:

  • Aggregate Reporting: Google combines data from visitors who have turned on Ads Personalization in their Google Accounts to provide aggregate, non-personally identifiable demographic profiles (e.g., age bracket, gender category, general interests). We do not merge this aggregate data with your customer billing, shipping, or contact records.
  • Notice of “Sharing”: Under the California Consumer Privacy Act as amended by the California Privacy Rights Act (CPRA), enabling Google Advertising Features to deliver cross-context behavioral advertising or interest-based insights can be categorized as “sharing” personal information. We do not sell your personal data for financial compensation.

C. Data Retention

User-level and event-level data associated with cookies, user identifiers, and advertising IDs is retained in Google Analytics for a period of up to 14 months, consistent with our GA4 retention settings, after which it is automatically deleted on a rolling monthly basis.

D. Consent & Opt-Out Controls

We respect your privacy choices through the following mechanisms:

  • Consent Before Tracking: Non-essential analytics and advertising cookies are not set until you consent via our cookie banner.
  • Changing Your Choices: You can change your tracking preferences or revoke previously granted consent at any time through the settings in our cookie banner. If the banner does not reappear when you revisit the Website, contact us at adriana@am-photographyllc.com and we will assist you in updating your preferences.
  • Global Privacy Control (GPC): If your browser broadcasts a recognized universal opt-out signal, such as the Global Privacy Control (GPC), we treat it as a request to opt out of the sale or sharing of your personal information and of cross-context behavioral advertising.
  • External Google Opt-Out Tools: You can manage personalization settings in Google Ads Settings or install the official Google Analytics Opt-out Browser Add-on.

5. Cookies, Pixels, and Tracking Technologies

The Website utilizes cookies, web beacons, and similar technologies to enhance user experience and facilitate site features:

  • Essential/Necessary Cookies: Required for basic site navigation, secure sessions, and e-commerce shopping cart persistence.
  • Functional Cookies: Remember user preferences (such as regional display options or previously entered form data).
  • Analytics & Marketing Cookies: Used to assess site engagement and, with your consent, to serve relevant artwork promotions.

Non-essential cookies are not set until you consent via our cookie banner. You can manage your cookie choices at any time through the banner’s settings or by adjusting your browser settings. Disabling essential cookies may impact certain functionality, such as e-commerce checkout.

6. Comments and Social Media Interaction

If you leave a comment on the Website, we retain the comment and related information (such as your email address and browser information) for as long as needed to display and moderate discussions, subject to applicable law and deletion requests. Your name and any website you submit are displayed publicly; your email address is not published and is not shared with third parties for their own purposes. Our hosting and spam-prevention providers process comment data as needed to operate and protect the Website.

Social media sharing options and links (e.g., Instagram, Pinterest, YouTube, Facebook) may be available on this Website. Interacting with these external platforms is voluntary and governed by the privacy policies of the respective social media networks.

7. Email Marketing & Communications

You can opt in to our email list to receive announcements regarding fine art print releases, special promotions, and gallery updates. We add you to the list only after your affirmative consent through our signup form; the same form lets you unsubscribe at any time. Separately, we may use your email address to communicate about orders and inquiries you initiate.

  • Our Commitments: We do not send misleading subject lines or deceptive headers, and we do not sell, rent, or trade your email address with third parties for their independent marketing purposes.
  • Opting Out: You may unsubscribe from our promotional communications at any time by clicking the “Unsubscribe” link located in the footer of every email we send, or by contacting us directly at amphotography108@gmail.com..

8. Disclosure of Your Information

We do not sell your personal data. We disclose personal information only under the following limited operational circumstances:

  • Service Providers: To the third-party service providers identified in Section 2, who assist us in operating our Website, delivering and protecting our infrastructure, processing merchant payments, fulfilling print orders, and distributing newsletters.
  • Legal Compliance: When required by law, subpoena, or legal process; to protect our rights; to defend against legal claims; or to ensure public safety.
  • Business Transfers: In the event of a merger, acquisition, corporate restructuring, or asset sale, customer records may be transferred to the acquiring entity subject to the commitments in this Privacy Policy.

9. California & US State Consumer Privacy Notice (CCPA / CPRA)

This section supplements our Privacy Policy and applies to residents of California and other US states with comprehensive consumer privacy statutes, to the extent such laws apply to us.

A. Sale and Sharing of Personal Information

  • No Sale of Personal Data: We do not sell your personal information (such as your name, billing address, or contact details) for monetary or other valuable consideration, and we have not done so in the preceding 12 months.
  • Sharing for Cross-Context Behavioral Advertising: Where enabled, we disclose online identifiers and browsing behavior via third-party tools (such as Google Analytics Advertising Features) to analyze engagement and deliver relevant art advertisements. Under the CPRA, this activity may constitute “sharing” personal information.

B. Your Consumer Privacy Rights

If you are a resident of an applicable US state, you may have the right to:

  • Opt Out of Sale or Sharing: Direct us not to share your personal information for cross-context behavioral advertising by contacting us at adriana@am-photographyllc.com, or by enabling the Global Privacy Control (GPC) in your browser.
  • Know and Access: Request details regarding the categories and specific pieces of personal information collected about you, along with the business purposes for collection.
  • Correction: Request correction of inaccurate personal data held by us.
  • Deletion: Request the deletion of your personal data, subject to statutory exceptions (such as completed transaction records required for tax and accounting audits).
  • Non-Discrimination: Exercise your privacy rights without experiencing discriminatory pricing, altered service terms, or degraded site performance.

C. Exercising Your Rights

To submit a verifiable consumer request, contact us at adriana@am-photographyllc.com. Only you, or an agent legally authorized to act on your behalf, may submit a verifiable consumer request. We verify requests using information proportionate to the sensitivity of the information at issue (for example, by matching your email address with our order or subscriber records), and we do not require identity verification solely to opt out of sale or sharing. We respond within the time required by applicable law (for California residents, within 45 days, extendable by an additional 45 days where permitted). If we decline a request, we will inform you of the reason and of any right you may have to appeal our decision within our internal process and to submit a complaint to the California Privacy Protection Agency.

10. GDPR Visitor Rights (EU & UK Residents)

Where the GDPR or UK GDPR applies to our processing and you are located in the European Union or the United Kingdom, you have the following statutory rights, subject to the conditions and exceptions in those laws:

  • Right of Access: Request confirmation of whether your personal data is being processed and obtain access to that data.
  • Right to Rectification: Request the correction of inaccurate or incomplete personal records.
  • Right to Erasure (“Right to be Forgotten”): Request the erasure of your personal data when it is no longer required for the purpose for which it was collected, when consent is withdrawn, or when otherwise required by law.
  • Right to Restrict Processing: Request the restriction of processing while accuracy or objections are verified.
  • Right to Data Portability: Where processing is based on consent or contract and carried out by automated means, request a copy of your personal data in a structured, commonly used, machine-readable format.
  • Right to Object: Object to processing based on legitimate interests or direct marketing at any time.
  • Right to Lodge a Complaint: Lodge a formal complaint with an appropriate Data Protection Supervisory Authority in your country of residence.

Some of our service providers (including Google, Cloudflare, and Pic-Time) are based in the United States. Where a transfer mechanism is required, we rely on safeguards recognized under applicable data protection law, such as the EU-U.S. Data Privacy Framework for recipients certified under it.

To exercise any of these rights, email your request to amphotography108@gmail.com. We will respond within one month of receipt, extendable by up to two further months where necessary given the complexity or number of requests, and we will inform you of any such extension.

11. Children’s Privacy

The Website is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, please contact us and we will delete it.

12. Data Security and Retention

We implement commercially reasonable administrative, technical, and physical safeguards to protect your personal information against unauthorized access, loss, or disclosure. Payment transactions are encrypted via SSL/TLS and transmitted directly to PCI-compliant payment gateways.

While we maintain rigorous security protocols, no method of transmission over the Internet is completely infallible. In the event of a confirmed data security incident affecting your personal information, we will notify affected individuals and regulatory bodies in accordance with applicable legal requirements.

We retain personal information only for as long as necessary to fulfill the purposes for which it was collected, including satisfying legal, accounting, tax, and order fulfillment obligations. Subscriber and customer records are retained while your subscription or customer relationship is active and thereafter as needed for these purposes or until you request deletion (subject to the exceptions noted in Section 9).

13. Policy Updates

We may modify this Privacy Policy periodically to reflect changes in regulatory standards or our website operations. Modifications take effect immediately upon posting to this page. The “Last Updated” date at the top of this document indicates the most recent revision.
